First of all..................

Why do breeders even have a contract?

For three basic reasons: one, to protect the buyer from an unscrupulous breeder; two, to protect the breeder from a dishonest buyer. The third and most important reason is to protect the animal being sold.

A good contract will very clearly set out your responsibilities as a buyer, and the breeder's obligations as the seller. If there are points of concern not covered, they can be discussed and perhaps added in another clause. Should a buyer object to a particular clause; it may signal to the breeder that this is a person you do not want to sell to.

Some potential buyers may feel the terms are too restrictive, but they must realize that every clause is there for a reason. I feel that as a breeder, it is my moral and ethical responsibility to see that the animal always has a safe and caring home. Breeders are not trying to control the Buyer. They are trying their best, to protect the animal. What it comes down to is this: If a buyer intends to care for the animal, they have nothing to worry about.

We reserve the right not to sell our kittens to families with children under six years old. Kittens are very fragile creatures and most young children, through no fault of their own, do not understand that a kitten must be handled very carefully and gently, and never be chased or hit with anything. Whether we will let a family with young children adopt one of our kittens or not will depend on our observation of the children's behaviour when they visit our cattery.

Larami Kitten Sales Contract

Our Sales Contract consists of this page, the Health Guarantee and the Sales Agreement. The purchaser and seller both agree to be bound by these terms and conditions to assure safe and humane treatment of the kitten involved.

1)  Buyer agrees to keep the kitten in a clean and pleasant environment, uncaged and with proper nutrition, health care, toys and companionship.

2)  Buyer agrees that under NO circumstances will this kitten EVER be sold, leased, or given to any pet shop, animal shelter, research laboratory, or similar facility.

3)  Buyer agrees to keep the kitten indoors at all times unless in a carrier or in an escape proof enclosure. This includes when the kitten is a full grown cat. If the cat is allowed to walk outdoors on a leash, please read clause 4 and 5 of our Health Guarantee.

4)  Buyer agrees that this kitten must not be declawed. Declawing is a horrible mutilation involving the amputation of a large portion of the kitten’s toes which in most cases will alter a kitten’s personality and cause undesirable side effects. Instead of declawing, the buyer agrees to keep the kitten’s toenails trimmed regularly, and to supply the kitten with proper scratching material and suitable training. There are good alternatives to declawing which we would be more than happy to discuss.

5)  Buyer agrees that this kitten will always receive prompt, top-notch medical care and will never be allowed to harbor fleas or other parasites. Obligatory veterinary requirements also include an annual booster vaccination for the common feline diseases such as calicivirus, rhinotracheitis, chlamydia, and panleukopenia (usually given in one combination shot), as well as emergency and extreme requirements such as accidents or unexpected infections and/or other health problems.

6)  Buyer agrees that if the kitten is found to be neglected or mistreated, Seller shall have the unconditional right to reclaim the kitten WITHOUT refund of purchase price. Neglect shall include, but is not limited to: being left alone without human companionship for periods in excess of 72 hours; lack of proper sanitary facilities; being caged for other than medical reasons; poor diet; and poor health (that is not being currently treated). Mistreatment shall include, but is not limited to: lack of proper food, lack of water and physical abuse.

7)  If the kitten is returned to us within 3 days, due to your allergies, you will forfeit your deposit. If you cancel your kitten purchase after giving us a deposit to reserve a kitten for you, you forfeit your deposit.

8)   After receiving a deposit from the Buyer and prior to the kitten leaving our home we reserve the right to cancel the contract if we believe we have been misled to the point where we feel the kitten’s health or emotional well-being would be in jeopardy by going to the buyer’s home. In such circumstances the paid deposit would be refunded at our discretion.     

Larami Kitten Health Guarantee

1)  EXTREMELY IMPORTANT! This kitten is guaranteed of sound health upon leaving the Seller’s premises and for a period of 72 hours thereafter if vetted within that time. Failure to have animal checked by a licensed veterinarian within that 72 hour period will void this guarantee. It is recommended that the new kitten be quarantined from any other animals during this 72-hour period.

2)  If the veterinarian finds this kitten is ill with a disease that incubated prior to purchase, the buyer agrees to call Seller immediately and return kitten to Seller for medical care provided by Seller’s Veterinarian at no cost to buyer. Seller will replace kitten with next available kitten if not well within sixty days.

3)  If the veterinarian finds this kitten to be medically deficient with an untreatable or life-threatening problem, this must be reported to the Seller immediately. The Seller reserves the right to either issue a full cash refund or replace it with another kitten of equal value. If no replacement is available at the time of return, Seller will have six months to furnish a comparable kitten.

4)  If the kitten should become ill, while in the Buyer’s care, for any condition other than a hereditary or congenital condition after this 72 hour period, the seller is not responsible for any expenses, nor obligated to take the cat back and make it well, nor replace it, nor refund any monies paid.

5)  Seller will not honor this health guarantee if the kitten dies of a virus from contact with another animal not bred at this Cattery.

6)   Under no circumstances is the kitten to be destroyed prior to notification by the Buyer to the Seller. If a kitten dies within the guarantee period, despite medical treatment, compensation or substitution will be made ONLY if the death can be attributed to a genetic defect and ONLY if a veterinarian certifies the cause of death. It is the Seller's right to ask for the kitten to be returned for identification before providing a replacement or any compensation.

7)  This kitten has an accompanying vaccination certificate. It has been fully vaccinated for the common feline diseases such as calicivirus, rhinotracheitis, chlamydia, and panleukopenia given in one combination shot at 8 weeks and again at 12 weeks of age.

8)  This kitten is guaranteed to be FeLV and FIV negative and free of ringworm when it leaves our cattery.

9)  In no way are we against vaccinating and protecting your kitten from potential health hazards, however, it is agreed by both Buyer and Seller that this Health Guarantee is null and void if the buyer has the kitten vaccinated for FELV (Feline Leukemia) or FIP (feline infectious peritonitis). Besides endangering the life of your kitten these vaccines are very stressful to the immune system of a young kitten and are not necessary for the continued health of an indoor-only cat who doesn't have repeated contact with other cats. FELV, Feline leukemia, IS a contact disease. Only through the contact with an infected cat can this be transmitted. While the Feline Leukemia vaccine is relatively safe, it has a minimum protection rate of only 80%. The FIP vaccine is highly controversial and it has proven ineffective against most strains of the corona viruses associated with the disease. No one knows much about FIP or how it is transmitted. Speculation is that it is an immune system defect. All cats that have FIP die! Cats/kittens do not build a lasting immunity to this virus and the vaccine may actually cause your cat to contact the virus. The tests for FIP are highly unreliable and can only, at best, verify exposure to a virus of this type, not necessarily FIP. The FIP test must be repeated several times, as an exposed cat can shed the virus, but never become ill. Keeping your kitten away from others and indoors at all times, is your best guarantee for avoiding exposure. If you and/or your Veterinarian decide to give either of these vaccines, the Seller shall not be held responsible in any way. NO refund or replacement will be given.

10) This kitten is guaranteed against congenital defects for one year. Should the kitten die within that time as a direct result of a congenital defect, it will be replaced ONLY if an appropriate autopsy is performed by a licensed veterinarian and a veterinarian's certificate is provided as proof of cause of death. A replacement will be made with a kitten of comparable quality and value, as available, at the discretion of Seller. NO CASH REFUNDS.
